If you entered the UK under the Highly Skilled Migrant Programme (HSMP) prior to 07 November 2006, it is now easier to extend your visa. In addition, if you have already been denied an extension to your visa, you can have the UK Border Agency reconsider your application.
The UK High Court found that the UK Border Agency acted unlawfully in requiring HSMP visa holders who entered the UK prior to 07 November 2006 to apply for an extension under a new and more difficult points based system. Many people who had left everything to move to the UK found themselves being forced to switch into a different immigration category -- or even leave Britain.
However, thanks to the efforts of the HSMP Forum Ltd, an advocacy group for HSMP visa holders who filed the judicial review that led to the judgment, many people can now breathe a sigh of relief.
If you received an HSMP Approval letter dated prior to 07 November 2006, send an email to hsmp@workpermit.com and an immigration adviser will contact you about assisting you with your application for an extension to your HSMP visa.
Even if you have already been denied an extension to your HSMP visa under the rules in place now, you can have your application reconsidered under the rules that were in place before 07 November 2006.
